Terms and Conditions

Effective date: 15 October 2026

These terms explain how you can use Graduate Farmer (www.graduatefarmer.co.ke), our courses, community and shop. By creating an account, buying from us or using the site, you agree to them and to our Privacy Policy. If you don’t agree, please don’t use the site.

1. Who we are

Graduate Farmer Limited runs this website. We are based in Kapseret, Eldoret, Kenya.

Email: business@graduatefarmer.co.ke Phone / WhatsApp: 0798857668 Hours: Monday to Friday, 8:00 am to 5:00 pm EAT. Saturday, 8:00 am to 12:00 noon.

2. Your account

  • You must be 18 or older to open an account or buy products. Younger learners may use free courses with a parent or guardian’s consent and supervision.
  • Give us accurate details and keep them up to date.
  • Keep your password safe. You are responsible for activity on your account, so tell us straight away if you think someone else is using it.
  • One person, one account. Please don’t share or sell your account.
  • If you sign up for a business, group or cooperative, you confirm you are allowed to agree to these terms for it.

3. Courses and learning content

  • Our free courses are for your own personal learning. Please don’t copy, record, resell or share course materials without our written permission.
  • We may add, change or remove courses at any time.
  • Our content is general farming information. Results depend on soil, weather, seed, pests, markets and how you manage your farm, so we can’t promise any yield, income or profit.
  • Always read product labels and speak to a qualified agronomist or your county extension officer before using a new input or chemical.
  • Certificates show that you took part in a course. They are not an official qualification unless we say so.

4. Products and regulated items

  • We describe products as accurately as we can. Photos are for illustration, and colours, packaging or plant size may vary slightly.
  • Seeds, planting material, fertilisers and pest control products are controlled by Kenyan law. We source from licensed or certified suppliers, and we may refuse, limit or cancel an order to follow the law or plant movement rules (for example from KEPHIS or county authorities).
  • Seedlings and other perishables are sensitive to handling and weather. Please be ready to receive and plant them as instructed.
  • Read and follow all labels and safety instructions. Wear protective equipment, store chemicals away from children, animals and food, and dispose of packaging responsibly.
  • Products are for lawful farming use only. Don’t resell regulated products unless you hold the licence the law requires.
  • If an item is out of stock after you order, we will tell you quickly and refund anything you paid for it.

5. Orders and payment

  • Placing an order is an offer to buy. Your order is confirmed only when we send you a confirmation (email, SMS or in your account) and your payment has cleared.
  • We may cancel an order for reasons such as stock or pricing errors, suspected fraud, or if we can’t deliver to your location. If you have already paid, we will refund you in full.
  • Prices are in Kenya Shillings (KES) and include VAT where it applies. Delivery fees are shown at checkout.
  • You can pay by M-Pesa, card or bank transfer, as shown at checkout. Payments are handled by licensed payment providers. We never store your full card details or M-Pesa PIN.
  • Keep your payment reference. If you pay and can’t see your order, contact us with it.
  • If we price something wrongly, we will contact you so you can confirm the order at the right price or cancel for a full refund.

6. Delivery

  • We deliver to the areas shown at checkout. Delivery times are estimates and can be affected by weather, roads, holidays and supplier delays.
  • Give us a correct address and a phone number we can reach. If delivery fails because of wrong details or no one being available, we may charge reasonable redelivery or storage costs, and perishable goods may be lost.
  • Please check your order when it arrives. Report visible damage, missing items or wrong items within 48 hours of delivery, or within 24 hours for seedlings and perishables. Photos help.
  • The products become your responsibility once delivered (or collected). You own them once we receive full payment.

7. Cancellations, returns and refunds

  • Cancel before dispatch: You can cancel any order before it is dispatched and we will refund you in full.
  • Faulty, damaged or wrong items: Tell us within the reporting window above. We will repair, replace or refund the item and cover reasonable return costs.
  • Change of mind (equipment only): You can return unused equipment in its original condition and packaging within 7 days of delivery. You pay the return cost unless the item was faulty or wrong.
  • Not returnable for change of mind: seedlings and other perishables, seeds, fertilisers, pesticides and other chemicals, and made-to-order items. If any of these arrive faulty or wrong, we will put it right.
  • Plant losses: We may ask for photos and details of planting and care to work out whether a loss was caused by a product defect or by conditions after delivery.
  • Refunds: Approved refunds go back to your original payment method or M-Pesa number within 7 to 28 working days. Your bank or provider may add some delay.
  • Nothing here limits your rights under the Consumer Protection Act, 2012.

8. Equipment warranties

Some equipment comes with a manufacturer or supplier warranty, shown in the product details. We will help you make a claim where we can. Warranties don’t cover misuse, wrong installation, poor maintenance, unsuitable fuel or inputs, unauthorised repairs, normal wear and tear, or accidents and natural events.

9. Community rules and your content

You agree not to:

  • break the law or infringe anyone’s rights;
  • give false information, pretend to be someone else or commit payment fraud;
  • upload viruses, interfere with site security, or scrape data or use bots;
  • post unlawful, abusive, hateful, obscene or misleading content, or spam;
  • give unsafe advice, such as unsafe chemical use or promoting unregistered products.

You keep ownership of what you post (comments, reviews, photos). You give us a free, non-exclusive licence to display and use it to run, promote and improve Graduate Farmer. We will ask for your specific permission before using your name or photo in marketing.

We may remove content or suspend accounts that break these rules. Advice from other members is not professional advice, so use your own judgment.

10. Our content

The Graduate Farmer name, logo, courses, design and software belong to us or our licensors. Please don’t copy, sell or modify them without our written permission. If you think something on the site infringes your rights, email us and we will look into it promptly.

11. Your privacy

We handle your personal data in line with the Data Protection Act, 2019. Our Privacy Policy explains what we collect, why, who we share it with and your rights. We will ask for separate consent for things like marketing, and you can withdraw it at any time.

12. Limits on our responsibility

  • The site and free content are provided “as is”. We can’t promise they will always be available, error-free or perfectly up to date.
  • Third-party links, couriers and payment providers are outside our control.
  • We are not liable for indirect losses such as lost profit, crops or income. For an order, our liability is limited to the price you paid for the products concerned.
  • Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or anything the law doesn’t allow us to limit, including your rights under the Consumer Protection Act, 2012.
  • You agree to cover us for losses caused by your breach of these terms or unlawful use of the site or products, except where we caused the problem.
  • We are not responsible for delays caused by events beyond our control, such as drought, floods, plant disease, quarantine, government action, strikes, power or internet failure, or supplier problems. If we can’t fulfil an order, we will offer a refund or a fair alternative.

13. Closing or suspending accounts

You can close your account any time in your settings or by contacting us. Confirmed orders are not affected. We may suspend or close an account if these terms are broken, we suspect fraud, or the law requires it. Where we can, we will warn you first and let you respond.

14. Changes, complaints and the law

  • We may update these terms. The new version will carry a new “Last updated” date, and we will notify you of major changes. If you keep using the site after that, you accept the update. Orders already confirmed follow the terms in place when you ordered.
  • If you have a complaint, email us first. We aim to reply within 5 working days.
  • If we can’t resolve it within 30 days, we will both try mediation before going to court.
  • These terms are governed by Kenyan law and Kenyan courts have jurisdiction. You can also use the Small Claims Court where it applies, or contact the Competition Authority of Kenya or the Office of the Data Protection Commissioner.
  • These terms and our Privacy Policy are the whole agreement between us. If any part is found unenforceable, the rest still applies.
